The petitioner seeks bail in connection Piri Bazar Case No. 17 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R., later on his name transpired on the confessional statement of the co-accused and nothing has been recovered on the basis of confessional statement from conscious possession of the petitioner. The petitioner is incarcerating in jail custody since 04.03.2016.
Learned A.P.P.
opposes the prayer of bail application.

No.53854 of 2016 (2) dt.15-12-2016 2/2 Having heard both sides, after perusal of the impugned order it appears that the some relevant paras of the case diary had been mentioned in the impugned order, showing against the petitioner. However learned counsel for the petitioner has stated that so far para 18 is concerned it is confessional statement of the petitioner, so far para 22 of the case diary is concerned it is confessional statement of co accused namely Jitan Kora, in para 27 and 29 Criminal antecedent of the petitioner and others are mentioned.
Considering the facts and circumstances of the case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) two sureties of the like amount each to the satisfaction of learned S.D.J.M, Lakhisarai, in Piri Bazar P.S. Case No. 17 of 2016.
