The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Ahiyapur P.S. Case No. 559 of 2019 registered for the offence punishable under Section 394 of the Indian Penal Code.

The allegation is regarding the accused persons having committed loot by intercepting the informant who was returning from a shop and was carrying mobile, cash and motorcycle.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and at the time of filing of the present case, he was having a clean antecedent. It is further submitted that the petitioner is

Patna High Court CR. MISC. No.58828 of 2019(2) dt.01-10-2019 2/2 languishing in custody since 11.05.2019 and similarly situated co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 02.08.2019 passed in Criminal Misc. No. 48160 of 2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 559 of 2019.
