The petitioner seeks bail in Barhara P.S. Case No. 245/2016, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The allegation against the petitioner is that he along with two others committed murder of the son of the informant and threw the dead body.

It has been submitted on behalf of the petitioner that he is in custody since 01.08.2016 and he has got no criminal antecedent. The police have already submitted charge-sheet and so there is no chance of tampering the evidence. Two other coaccused, having dispute with the informant, have been allowed bail in Cr. Misc. No. 51435/2016 and the case of the petitioner stands on similar footing. The petitioner has remained in custody

Patna High Court Cr.Misc. No.54210 of 2016 (2) dt.21-12-2016 2/2 for more than four months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barhara P.S. Case No. 245/2016.
