2. This application for grant of anticipatory bail arises out of Kasma P.S. Case No. 76 of 2025 dated 08.06.2025, disclosing offence under Section 329(4), 126(2), 115(2), 109(2), 74, 303(2), 352, 351(3), 3(5) of the B.N.S. And Section 37(C) of the Bihar Prohibition and Excise Act, 2022.

3. The prosecution case, as per the First Information Report, is that on 08.06.2025 at 9:00 A.M., the petitioner along with other accused persons including 5 to 6 unknown persons arrived at the house of the informant and entered into her house and snatched Rs. 30,000/- along with

It is alleged that the accused Shashi Kant Singh and Nilkamal Singh assaulted the informant with iron rod and they also torn her cloths. When her son intervene to save her, Shashi Kant Singh assaulted him with Gaita causing head injury.

4. Learned counsel for the petitioner submits that the petitioner is having clean antecedent and has not committed any offence. She further submits that entire family members have been made accused in this case due to village rivalry. The allegation against the petitioner is general and omnibus in nature and the specific allegation of assault is attributed to the co-accused, Shashi Kant Singh and Nil Kamal Singh. Referring to the injury report at Annexure-2 series, learned counsel for the petitioner submits that injuries sustained by the informant and her son are simple in nature.

5. Learned A.P.P. for the State opposed the prayer for anticipatory bail.

6. Regard being had to the submission made by the parties and taking into consideration the fact that there is general and omnibus allegation against the petitioner and the injuries sustained by the informant are simple in nature

Patna High Court CR. MISC. No.62157 of 2025(2) dt.24-09-2025 3/3 and the petitioner has no criminal antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioner.

7. This application is, accordingly, allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, (Excise- I), Aurangabad in connection with Kasma P.S. Case No. 76 of 2025/ G.R. No. 316 of 2025, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
