2. The petitioners have preferred this application for grant of regular bail in connection with Chitragupt Nagar P.S. Case No. 03 of 2025 dated 10.01.2025 registered for the offences punishable u/ss 331(4) and 305 of the B.N.S.
3. As per the prosecution case, on 08.01.2025, the informant received a call from his gardener namely, Sonu Kumar who informed him about a theft at his flat. Thereafter, the informant informed his brother and his son, who visited his flat and found that the inner gate was broken. When the
Patna High Court CR. MISC. No.62411 of 2025(2) dt.17-09-2025 2/3 informant reached his flat, he found that many articles including an i-phone, gold jewellery and Rs. 2 lakh in cash were missing.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the F.I.R. The name of the petitioners has sprung up in the confessional statement of the co-accused, Chotu Kumar @ Chhotu Kumar. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The petitioner no. 1 has two criminal antecedents whereas the petitioner no. 2 has four criminal antecedents as stated in para 3 of the bail petition. As per the impugned order dated 02.08.2025, the petitioners are in custody since 18.04.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Chitragupt
Patna High Court CR. MISC. No.62411 of 2025(2) dt.17-09-2025 3/3 Nagar P.S. Case No. 03 of 2025 with the condition :- (i) The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
