Petitioner apprehends arrest in Ekma PS Case No. 79 of 2019 registered under Sections 323, 324, 379, 307, 498A and 420 IPC.

The complainant (wife) has made allegation that subsequent upon her marriage in the year 2010 she has been subjected to cruelty and ousted from her matrimonial home. The allegations further disclose that the criminal case was disposed of on the basis of compromise and undertaking by the petitoner regarding maintaining the wife with full honour and dignity. Even after such undertaking he has again violated the same and subjected the informant to torture and assault.

The matter was earlier referred to the Mediation Center for attempt to resolve the dispute. Report of the Mediator dated 22.1.2020 is that the efforts for mediation could not succeed. Having regard to the nature of the allegation and the fact that the petitioner is the husband owing the prime responsibility of
