JUSTICE SANJAY PRIYA ORAL ORDER 2/ 04-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Madanpur P.S. Case No.87 of 2014 instituted for the offence under Section(s) 3⁄4 of the Explosive Substance Act and Section 17 of the CLA Act. It has been submitted that there is general and omnibus allegation against the petitioner. Nothing has been recovered from his possession. Other co-accused with similar allegation has been granted regular bail by a co-ordinate Bench of this Court by order dated 17.03.2016 passed in Cr. Misc. No.11933 of 2016.

From the written report, it appears that the police party found some explosive substance planted ahead of

Patna High Court Cr.Misc. No.2251 of 2017 (2) dt.04-02-2017 2/2 Panchrukhiya with intention to cause harm to the police party. Petitioner's name appears at serial no.32 in the First Information Report. It appears from the written report itself that nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 02.07.2016.

In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st, Aurangabad, in connection with Madanpur P.S. Case No.87 of 2014 giving rise to Sessions Trial No.521 of 2016/ 57 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
