Mr.Ajay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-12-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Sanjhauli P.S. Case No. 97 of 2019 registered for the offence punishable under Sections 341, 323, 307, 354 and 504/34 of the Indian Penal Code.

The allegation is regarding the petitioners having assaulted the informant and his family members on account of dispute pertaining to an ancestral property.

The learned counsel for the petitioners submits that the

No.80071 of 2019(3) dt.09-12-2019 2/2 petitioners and the prosecution party are close relatives and on account of land dispute, some altercation had taken place, however, the injury report would show that all the injuries are simple in nature. It is further submitted that the petitioners are having a clean antecedent and they are respected people of the village.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramgan (Rohtas) in connection with Sanjhauli P.S. Case No. 97 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
