2. Heard learned counsel for the petitioner, learned counsel for the Mines Department and learned counsel for the State.
3. After some arguments, learned counsel for the petitioner outrightly submits that this writ application may be disposed of with liberty to the petitioner to file a statutory appeal under Rule 67 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rules,
Patna High Court CWJC No.14605 of 2023(4) dt.28-01-2025 2/2 2019 before the Collector of the District.
4. If the petitioner files a statutory appeal before the respondent No.5 within a period of four weeks from the date of receipt/production of a copy of this order, respondent No.5 is directed to hear the appeal of the petitioner in accordance with law and dispose of the same after hearing all concerned within a period of eight weeks from the date of filing of such appeal.
5. With the aforesaid liberty, this writ application stands disposed of.
