ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.05.2017 in connection with Jagdishpur P.S. Case No.118 of 2017 registered for the offence under Sections 376 and 511 of the Indian Penal Code and Section 8 of the POCSO Act. It is submitted that the petitioner was not apprehended at the place of occurrence, but his name has been brought in in connection with the present case on account of neighbourly enmity. Learned counsel for the petitioner further submits that the normal procedure to be followed is to send the victim girl for medial examination and also to record her statement. However, none of these have been complied with

Patna High Court Cr.Misc. No.38373 of 2017 (3) dt.21-09-2017 2/2 till date. He further submits that the petitioner had got a clean past and has been falsely implicated.

Considering the aforementioned facts and circumstances and having heard learned counsel for the petitioner and the learned counsel for the State, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- 1, Bhojpur, Ara, in connection with Jagdishpur P.S. Case No.118 of 2017.
