JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-08-2022 With the consent of the parties, the impugned order, dated 25.11.2017, passed, in Title Suit No. 538 of 2010, by learned Sub Judge-I, Patna is set aside.

The petitioner-defendant no. 3 is permitted to contest

Patna High Court C.Misc. No.553 of 2018(5) dt.08-08-2022 2/2 the suit on its merit. Since the evidence of the parties has not concluded, the petitioner-defendant no. 3 is permitted to file written statement within a period of six weeks from today. Since the suit is of the year 2010, the learned Court below is directed to expedite the disposal of the suit within a reasonable time frame without giving unnecessary adjournments to either parties.

This application is disposed with the aforesaid observation and direction.
