The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 325, 307/34 of the Indian Penal Code.

As per the prosecution case, all the F.I.R. named accused persons including this petitioner assaulted the informant and his son by means of lathi, danda & iron rod, as a result of which, both of them sustained injury.

It is submitted on behalf of petitioner that allegation of assault is general and omnibus. The injury sustained by the informant and his son has been found to be simple in nature by the doctor. It is further submitted that there is delay of 12 days in lodging the F.I.R. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.62648 of 2022(2) dt.17-03-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Teghra P.S. Case No. 235 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
