Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

No doubt, petitioner carries criminal antecedent of several cases but omnibus allegation of assault has been levelled against him. Learned counsel for the petitioner drew my attention towards annexure 2 to the petition and submitted that when the informant of the present case was examined by the Medical officer of Primary health centre, Siwan, three injuries were found on the person of the informant and doctor opined that all injuries were simple in nature caused by hard and blunt substance. Furthermore, in the aforesaid injury report, doctor did not refer the informant to Sadar hospital, Siwan but subsequently, the same doctor issued another injury report mentioning this fact that on the basis of x-ray report of

Patna High Court Cr.Misc. No.1366 of 2016 (2) dt.21-01-2016 Sadar hospital, Siwan, one injury of the informant was found grievous in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Siswan (Chainpur O.P) P.S.
