This is a petition for grant of anticipatory bail for offence under Section 7 Essential Commodities Act. On inspection of the Public Distribution System shop of the petitioner shortage of 23.72 quintal of wheat was noticed by the authorities.
Submission of the learned counsel for the petitioner is that without proper verification of entire records of receipt and supply of the food grains, the said report has been submitted. The petitioner has got no criminal antecedent.
Considering the fact, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rajauli P.S. Case No. 138 of 2017 to the satisfaction of the Chief Judicial Magistrate, Nawadah, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
