JUSTICE SHIVAJI PANDEY ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.91 of 2015 / 78 of 2015, arising out of Kako P.S. Case No.109 of 2014, registered for the offences punishable under Sections 302, 392/34 of the Indian Penal Code and under Section 27 of the Arms Act. Earlier, on two occasions, the petitioner has moved before this Court for bail vide Criminal Miscellaneous No.2595 of 2015 and 44348 of 2015. On both the occasions, the prayer for bail has been rejected by this Court.

This Court has received the report from the Additional Sessions Judge, II, Jehanabad, by which it has been

Patna High Court Cr.Misc. No.55599 of 2016 (4) dt.08-03-2017 2/2 informed that altogether five charge-sheeted witnesses have been examined and the evidence of doctor and three Investigating Officers are yet to be examined. The petitioner is in jail since 07.10.2014.

Having considered the facts and circumstances of the case and the period of custody, let the petitioner-Mithilesh Kumar be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Jehanabad, in connection with Sessions Trial No.91 of 2015/78 of 2015, arising out of Kako P.S. Case No.109 of 2014.
