ANJANA MISHRA ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 10.04.2019 in connection with Asthawan P.S. Case No. 177/2016 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the FIR, he was remanded in connection with the present case as he was in custody in connection with the Parsa Bazar P.S. Case No. 15 of 2017. Learned counsel for the petitioner further submits that the recovery of motorcycle was not from his conscious possession, but from outside his house and, therefore, he has been remanded on suspicion. It is also submitted that he has nothing to do with the alleged theft and he shall be appearing in Court as and when

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Nalanda at Bihar Sharif, in connection with Asthawan P.S. Case No. 177/2016.
