The petitioner seeks bail in a case instituted under Sections 366(A)/120(B) of the Indian Penal Code. The allegation against the petitioner is of committing abduction of the minor daughter of the informant. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application, with observation "at this stage".

A report was called for from the trial court regarding the stage of the case. It has been reported that the case is pending for evidence and process has been issued against the prosecution witnesses.

Patna High Court Cr.Misc. No.36233 of 2017 (3) dt.18-10-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2016. He has got no criminal antecedent. The petitioner has been falsely implicated in the present case, due to village politics.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Katihar, in connection with S.T. No.80/2017, arising out of Azam Nagar P.S. Case No. 123 of 2015.
