The learned counsel for the defendant-respondents is present. Calling in question the order rejecting the prayer for transfer of the miscellaneous case filed for setting aside the compromise decree, the petitioner has filed this application under Article 227 of the Constitution of India.

From the perusal of the impugned order, it appears that the only ground for transfer of the miscellaneous case was that the learned court below was giving short date in the matter and there was apprehension that the order would be passed against the petitioner.

Patna High Court CWJC No.47 of 2014 (2) dt.02-02-2015 After perusal of the impugned order, this Court does not find any illegality or error in the impugned order. The writ application is, accordingly, dismissed.
