The petitioner seeks bail in a case registered for the offence punishable under sections 392 of the Indian Penal Code.
The petitioner is not named in the F.I.R. but during investigation his name transpired in this case. It is submitted that after investigation, the police submitted final form finding no evidence but subsequently again the matter was re-opened and on the basis of the confessional statement of co-accused Chunnu Yadav, the petitioner has been dragged in this case and he is suffering in custody since
Patna High Court Cr.Misc. No.2479 of 2016 (3) dt.11-03-2016 12.09.2015 but he has not been put on T.I. parade and similarly situated other co-accused Indal Ram has been allowed bail and as such the petitioner also deserves sympathetic consideration. The learned A.P.P. is not in a position to distinguish the case of the petitioner with that of the accused. In the facts and circumstances of the case stated above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S.
