2. The petitioner has preferred this application for grant of regular bail in connection with Laukahi P.S. Case No. 24 of 2023 corresponding to G.R. No. 132/2023 dated 22.01.2023 registered for the offences punishable under Sections 447, 307 and 506 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, on 18.01.2023 some miscreants had assaulted and looted the informant at his shop. When he went to police to lodge complaint, two of them namely, Nitish Kumar Yadav and Rajan Kumar Yadav (the petitioner) came to the shop of the informant and the co-accused

Patna High Court CR. MISC. No.66158 of 2023(2) dt.13-10-2023 2/3 Nitish Kumar Yadav fired three rounds on the son of the informant due to which he sustained firearm injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has further submitted that no any gunshot injury was found as per the injury report. The allegation of firing is against the co-accused Nitish Kumar Yadav. The petitioner is accused in 12 other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 27.03.2023

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 24 of 2023 corresponding to G.R. No. 132/2023, with the condition ;- (i). The petitioner is directed to remain physically

Patna High Court CR. MISC. No.66158 of 2023(2) dt.13-10-2023 3/3 present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
