JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406,420 and 506/34 of the Indian Penal Code.

It is alleged that the petitioners persuaded the informant to make investment in Bajaj company to get three times of the invested amount in seven years. The informant gave rupees sixty nine thousand and some ornaments to invest rupees one lac and after seven years when it was asked to make payment of rupees two lacs twenty thousand, the payment was not made and the informant was threatened.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.452 of 2016 (2) dt.08-01-2016 2/2 that there is nothing on record to suggest that the petitioner was given the money nor the petitioner is in any way connected with Bajaj company. More over, subsequently the petitioner no. 1 filed Complainant Case No. 726 of 2015 for not transferring the land in spite of taking consideration money by the informant. Considering the nature of accusation and the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Turkaulia P.S. Case No.245 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
