The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.09.2021, charge-sheet has been submitted and is a person with clean antecedent. Learned counsel for the petitioner submits that informant alleges that on 12.03.2019 a quarrel took place between his son (deceased) and two accused persons, namely, Ram Pravesh Singh (petitioner) alongwith Kaparphutta on account of dispute relating to fare of the auto. It is next alleged that the accused took the victim at the place of occurrence and assaulted him with fist and slaps due to which the victim had

Patna High Court CR. MISC. No.1107 of 2022(2) dt.23-05-2022 2/2 suffered intense pain in his abdomen and died during the course of treatment.

Learned counsel for the petitioner submits that the informant is not the eye witness to the occurrence and the entire allegation hinges around suspicion. It is next submitted that Sri Kant Singh @ Kaparphutta has been granted bail by order dated 18.11.2019 passed in Cr. Misc. No. 68200 of 2019. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 13.09.2021, charge-sheet has been submitted and is a person with clean antecedent, co-accused has been granted bail and informant is not an eye witness to the occurrence, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Fatehpur P.S. Case No. 68 of 2019.
