JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 30-01-2017 As prayed, petitioner is permitted to implead the Engineer-in-Chief-cum-Special Secretary, Road Construction Department as respondent no.7 in course of the date. Heard parties.

The petitioner, who had retired on 28.02.2009 as Assistant Engineer from Road Construction Department, claims that he was entitled for grant of third MACP in view of decision of the State Government dated 13.06.2013, as contained in Annexure-1, which was given from retrospective effect, i.e., from 1.01.2009.

Be that as it may, this Court is inclined to dispose of the writ petition with a liberty to the petitioner to approach afresh before the respondent no.7 by filing a detailed representation along with a copy of this order. In such case, let him take a decision on its own merit and in accordance with law expeditiously preferably within a period of three months from the date of filing of such representation.
