JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Both the above-said petitions arise out of Bettiah (Muffasil) P.S. Case No. 561 of 2015 registered under Sections489,(B), 489(C)/120(B) of the Indian Penal Code and accordingly, both the above-said petitions are being heard and disposed of by this common order.
Patna High Court Cr.Misc. No.1322 of 2016 (2) dt.14-01-2016 2/2 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. In huge quantity, counterfeit notes are said to have been recovered from conscious possession of both the petitioners. Submission on behalf of petitioners is that the seizure list is said to have been prepared on 30-09-2015 at 16.30 hours but the FIR and seizure list were put up before the learned Chief Judicial Magistrate on 02-10-2015 and, therefore, the aforesaid fact goes to show that seizure list is an ante dated document. Considering the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioners on bail and accordingly, their prayer for bail in connection with Bettiah (Muffasil) P.S. Case No. 561 of 2015 pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran stands rejected.
