JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Islampur P.S. Case No. 114 of 2019 registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.
Allegation against petitioner No.3 is that he assaulted the informant by means of Patty of Khatiya, causing injury on his head and petitioner Nos. 1 and 2 are named in the FIR and there is general allegation against them.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and injuries are found to be simple in nature.
Patna High Court CR. MISC. No.59380 of 2019(2) dt.19-09-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that there is specific allegation of assault against petitioner No.3 but he conceded that the injury is simple in nature.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 114 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
