The petitioner apprehends his arrest in connection with Navanagar P.S. Case No.319 of 2020, registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The prosecution case, in brief, is that the informant, S.I., Sanjay Kumar got information on 11.09.2020 at 06.00 a.m. in the morning that a dead body kept in a sack is seen beside NH-30. The informant reached at the place of occurrence and found a dead body of a woman.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail

It is further submitted that there is no eye witness of the occurrence and only on suspicion, the petitioner has been made accused in this case. The name of the petitioner transpired in the case on the basis of confessional statement of co-accused, Shailendra Yadav.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Anjani Kumar Sharan, J) Sanjay/- U T
