Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Nirmali P.S. Case No. 132 of 2021, lodged under Section 7 of the Essential Commodities Act.

As per prosecution case, the allegation is against petitioner to violate the provisions relating to E.C. Act, on the basis of which, present case has been filed.

Learned counsel for the petitioner submits that in the E.C. Act the total punishment is one year. He further submits that petitioner is in custody since 02.09.2021 and his antecedent

Patna High Court CR. MISC. No.1111 of 2022(3) dt.20-10-2022 2/2 is clean.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur in connection with Nirmali P.S. Case No. 132 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
