====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehend their arrest in connection with Barahara P.S. Case No. 143 of 2019 registered under sections 341, 323, 325, 307, 379, 504, 506/34 of the IPC. The allegation against the petitioners, is that petitioners arrived at the land of the informant and asked the informant to vacate the same. It has further been alleged that on the order of Surendra Mehta i.e. the petitioner no.1, all the accused persons assaulted the informant and her husband.
Mr. Ajit Kumar Singh, learned counsel appearing for
Patna High Court CR. MISC. No.59466 of 2019(2) dt.19-09-2019 2/2 the petitioners submits that both the parties are neighbours and there is land dispute between them. Learned counsel further submits that there is a case and counter case between the parties inasmuch as the Barahara P.S. Case No. 144 of 2019 has been lodged by the petitioner no. 2 against the informant and others. Learned counsel relying upon Annexure-3 and 4 submits that the informant as well as her husband have received simple injuries. After having heard learned counsel for the parties and taking into consideration the fact that both the parties are neighbours and there is a land dispute between them and there is a case and counter case between them, I am inclined to grant anticipatory bail to all the petitioners.
Accordingly, the petitioners, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Angira Kumari J.M. 1st Class, Purnea in connection with Barahara P.S. Case No. 143 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Sinha, J) Anjula/- U
