The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 21 litres of Nepali Soufi wine were allegedly recovered from the bag which was being carried on head by the petitioner who is said to be caught by the police on chase when he tried to escape. Petitioner claims that he is having clean antecedent and is in custody since 28.05.2017.
Considering the facts and the circumstances of
Patna High Court Cr.Misc. No.40312 of 2017(2) dt.25-08-2017 2/2 the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the I/c Additional District & Sessions Judge-cumSpecial Judge, Excise Act, Sitamarhi in connection with Kanhauli P.S. Case No. 64 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
