JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with K. Nagar P. S. Case No. 339 of 2015, disclosing offences under Sections 384 and 385 of IPC.

Allegation of demand of Rangdari by the petitioner to the informant and also asking to vacate the shop. Submission of the learned counsel for the petitioner is that he is aged about 68 years and the allegation is false and concocted. Earlier one Puja Kumari has lodged a case against the informant of the present case for the commission of rape, in which, petitioner was witness, though the case has been compromised and dispose of and due to that, this case has been lodged against the petitioner. Further submission is that he has no criminal antecedent.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P. S. Case No. 339 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he will not threaten the informant of the case or try to tamper with the evidence.
