2. The petitioners apprehend their arrest in a case registered for the offence under Sections 420, 494, 498(A), 504, 506, 354/34 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.
3. Petitioner is Nandosi (brother-in-law) of the informant and it is alleged that he alongwith other in-laws members of informant performed fourth marriage of informant's husband with one Shivani Kumari and informant was ousted from her matrimonial house.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.65224 of 2023(4) dt.02-07-2024 2/2 petitioner has been falsely implicated in this case merely because he is close relative of husband of informant. Thrust of the accusation is against husband of the informant. Petitioner is separate in mess and property and has got no concern with the family affairs of informant and her husband. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of petitioners.
6. However, considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Gaya in connection with Tekari (Mau O.P.) P.S. Case No. 81 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
