1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 498(A) and 504/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the informant submits that petitioner had moved this Court earlier seeking anticipatory bail by filing Cr. Misc. No. 46736 of 2024 and the same was permitted to be withdrawn by an order dated 05.07.2024.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that petitioner is in custody since 04.07.2024 and charge-sheet has been submitted and

Patna High Court CR. MISC. No.67115 of 2024(3) dt.07-10-2024 2/2 cognizance has been taken under Sections 341, 323, 498(A) and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the informant alleges that she was married to petitioner about 10 years back and has a child from wedlock, but petitioner was having relationship with Munni, further informant went to the house of Munni and saw her husband there and thereafter the accused assaulted. It is submitted that though informant is claiming to be the legally wedded wife of the petitioner, but then petitioner disputes the said fact that informant is his legally wedded wife.

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Be that as it may, considering the period of incarceration, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Harnaut P.S.
