This is an application for regular bail on behalf of the petitioner for the offence alleged under sections 30 and 30(a) of Bihar Prohibition of Excise Act, 2016.
As per allegation, having seen the police vehicle, the petitioner started fleeing away, 140 liters of liquor was recovered from the forest. Chaukidar Ram Singar Manjhi told the police party that it was the petitioner who fled away.
Learned counsel for the petitioner has submitted that while preparing seizure list, ingredients of section 100 Cr.P.C were

Considering the facts and circumstances and the period of custody of the petitioner, let the petitioner above named be released on bail only after framing of the charge on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum-Special Judge, Excise, Saran in connection with Maker P.S. Case no. 141 of 2020. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
