JUSTICE SANDEEP KUMAR ORAL ORDER 19-10-2023 Heard learned counsel for the petitioner and Mr. Rajiv Nayan, learned counsel appearing on behalf of the State. The petitioner seeks bail in connection with P. T.N. No. 2358 of 2023 arising out of Chowk P.S. Case No. 505 of 2023 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.08.2023 and there is recovery of 25 litres of country made liquor from his possession. Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Patna High Court CR. MISC. No.68524 of 2023(2) dt.19-10-2023 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Court of Excise, Patna City in connection with P.T.N. No. 2358 of 2023 arising out of Chowk P.S. Case No. 505 of 2023.

The petitioner will visit Chowk Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
