The petitioner seeks pre-arrest bail in connection with Case No. 235 C2 of 2018 for the offence alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on raid 6.480 liters of country made liquor recovered from the hut, situated in front of the house of the petitioner from where Varun Kumar, brother of the petitioner, was apprehended.

The submission of the learned counsel for the petitioner is that in fact petitioner used to reside in joint house from front of which the hut is situated from where the alleged liquor was recovered and the brother of the petitioner, namely, Varun Kumar, was apprehended. Petitioner, being the brother of

Patna High Court CR. MISC. No.60892 of 2019(2) dt.25-09-2019 2/2 Varun Kumar, has falsely been implicated in this case. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Case No. 235 C2 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Excise Act, Begusarai, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
