The petitioner seeks bail in Udwantnagar P.S. Case No. 202/2016, registered for the offences punishable under Section 395 of the Indian Penal Code.
The informant alleged that one person rang him and asked him to take him to Tirojpur Rajrapa. The informant became ready to carry the accused persons on his vehicle on payment of Rs. 2,000/-, but the accused persons snatched all the articles and threw the informant by the side of the road.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Nothing has been recovered from the possession of the petitioner. Petitioner is in jail since 27.06.2016 and he has not been put on Test Identification Parade,
Patna High Court Cr.Misc. No.55593 of 2016 (3) dt.02-03-2017 2/2 but from perusal of the case diary, it appears that S.I.M. from which the accused called the informant was recovered from the possession of the petitioner.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
