2. The petitioners seek bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354, 379, 504 and 34 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that inadvertently at para 3 it has been pleaded that petitioners are persons with clean antecedent when petitioner No. 1 has antecedent of one case. It is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that on account of land dispute Santosh assaulted the informant by farsa causing injury on head. It is next submitted that as far as

Patna High Court CR. MISC. No.66446 of 2024(2) dt.23-10-2024 2/2 petitioners are concerned, there is no specific allegation against them. It is further submitted that Sunny is alleged to have snatched a golden chain of the informant while all accused are alleged to have assaulted the informant.

Learned A.P.P. for the State and learned counsel appearing on behalf of the informant oppose the bail application but then they are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that there is no specific allegation against the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Kesariya P.S. Case No. 169 of 2024 subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
