The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 325, 307, 504 and 379 of the Indian Penal Code. Petitioners along with other accused persons are

Patna High Court CR. MISC. No.65887 of 2019(5) dt.04-03-2020 2/3 said to have assaulted the grandson of the informant by means of lathi and danda. Co-accused Nagehshwar Paswan gave sickle blow on his head and he sustained injury. When the informant was returning from market in the evening they also started abusing them and assaulted him by means of lathi and danda. Consequently, he fell down. Nandni Devi assaulted him by means of lathi. Anita Devi snatched Rs.15,000.00 from his pocket. When his son Gariban Paswan came to his rescue all the accused persons made good their escape.

It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. It is further submitted that the petitioners have not surrendered before the learned Court below till date. Petitioners have no criminal antecedent. Having heard the parties and perusing the case record, it appears that vide order dt. 4.11.2019, petitioners were granted provisional bail, but according to learned counsel for the petitioners till date they have not surrendered before the learned Court below, hence the period of surrender is extended by further six weeks from today and order dt. 4.11.2019, whereby they were granted provisional bail, is confirmed in connection with
