Petitioner apprehends his arrest in connection with Bihariganj P.S. Case No. 174 of 2016 registered for the offences punishable under Sections 354 (B) of the Indian Penal Code and Section 9 (F) of the POCSO Act.

Allegedly, the petitioner started misbehaving with the minor daughter of the informant at medical store. Submission is of false implication and that now good sense has prevailed between the parties, compromise petition has also been filed by the informant vide annexure-2. The husband of the informant was not paying the dues money to the petitioner despite several demand and when the petitioner started pressing for the payment of his money, exchange of hot words took place and the informant lodged this false case. Patna High Court Cr.Misc. No.883 of 2017 (2) dt.12-01-2017 has been settled amicably, the petitioner is aged about 55 years having children and is a respectable person of the locality. Learned APP fairly submits that now the matter has been compromised and the informant is not ready to support her earlier version.

In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Madhepura in connection with Bihariganj P.S. Case No. 174 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
