Heard learned counsel for the parties.
3. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414, 413/34 of the Indian Penal Code.
4. As per prosecution case, the petitioner along with one co-accused is said to have been apprehended with two motorcycles which are found to be stolen property.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. It
Patna High Court CR. MISC. No.67624 of 2023(3) dt.29-11-2023 2/2 is also submitted vide para 10 & 11 of the petition that the seized one motorcycle from where, the petitioner was apprehended, belongs to one Subodh Kumar Sant. The other motorcycle which is said to be stolen, for which, one another case has already been registered. The petitioner has no concern with the stolen vehicle or this offence. Moreover, he is languishing in judicial custody since 2.7.2023.
6. Learned APP appearing for the state has opposed the prayer of regular bail.
7. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail after framing of charge, if not framed in connection with Majorganj P.S. Case No. 180 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Sitamarhi.
