JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 304(B), 201 and 34 of the Indian Penal Code.

The prosecution story, in brief, is that the informant has given written information to the Officer Incharge of Sour Bazar Police Station on 06.11.2014 by mentioning therein that the marriage of his daughter Puja Kumari was solemnized with Babloo Sah in the year 2011 according to the Hindu reties and customs and she was residing at her matrimonial house with her husband and in-laws and after some time the accused persons started making demand of Rs. 50,000/- as dowry and due to non fulfillment of demand of dowry they started committing cruelty

Patna High Court Cr.Misc. No.15065 of 2015 (3) dt.02-07-2015 2/2 and torture on the person of Puja Kumari and ultimately on 4.11.2014 the accused persons committed murder of Puja Kumari. It has been submitted on behalf of the petitioners that that petitioners are mother-in-law and Dewar of the deceased. It is also submitted that the petitioners have got no criminal antecedent. It is also submitted that there is no specific allegation against the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B.K.Singh, learned Judicial Magistrate, Saharsa in connection with Sour Bazar P.S.Case No. 494/2014 corresponding to G.R.No. 2902 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
