The petitioner apprehends her arrest in Excise Case No.928 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The excise officials intercepted an auto rickshaw bearing Registration No.BR-26K/4833 and also apprehended Bijendra Kumar, the driver of the auto rickshaw, who tried to flee away, on chase. 80 litres liquor was recovered from the auto rickshaw.

Learned counsel for the petitioner submits that the petitioner is made accused in the case because the petitioner is the owner of the auto rickshaw. The petitioner is a lady. The husband of the petitioner purchased the auto rickshaw in the

Patna High Court CR. MISC. No.58533 of 2019(2) dt.20-09-2019 2/2 name of the petitioner and petitioner handed over the auto rickshaw to the driver of the auto rickshaw to ply on hire. Taking into consideration the facts and nature of allegation made against the petitioner and the fact that the petitioner being the owner of the auto rickshaw has been made accused in the case, let petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Excise Case No.928 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
