JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kopa P.S. Case no. 136 of 2016, registered under Sections 147, 149, 323, 427, 379, 308 & 504 of the Indian Penal Code. The accusation is that due to draining out of wastage water of the informant, five persons named in the F.I.R., including the petitioner, came at the door of the informant and started to abuse and also assaulted him through fists and slaps, When father of the informant reached there and made intervention then this petitioner caused injury to father of the informant at his head. Learned counsel for the petitioner submits that while four injuries found on the person of the father of the informant caused by hard and blunt substance, but all the said injuries are simple in nature. Further submission is that, in fact, occurrence took place due to

No.55349 of 2016 (2) dt.23-12-2016 2/2 draining out of wastage water and scuffle took place, then petitioner side also sustained injury regarding which mother of the petitioner lodged Kopa P.S. Case No. 135 of 2016, under Sections 341, 323, 324, 427, 504, 379,307 and 34 of the I.P.C.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Saran at Chapra in connection with Kopa P.S. Case No. 136 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
