====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in connection with Excise Case No. 518 of 2019 for the offence under Section 30(a) and 56(B) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 75 ltrs of foreign liquor was recovered. The petitioner is in custody since 12.08.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 25,000/- (Twenty Five thousand)

Patna High Court CR. MISC. No.59820 of 2019(2) dt.26-09-2019 2/2 in the Court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bonds of Rs. 25,000 (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Excise Case No. 518 of 2019.

The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
