JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2023 At the outset, learned counsel for the petitioners prays for and is permitted to make correction in paragraph 3 of the bail petition.

Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307/504/506/34 and other allied sections of the Indian Penal Code. Prosecution's case in short is that petitioners and

Patna High Court CR. MISC. No.73188 of 2022(2) dt.23-03-2023 2/2 other accused persons abused and assaulted the informant by means of iron rod as a result of which he sustained injuries on the neck and face.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Injury sustained by the informant has been found to be simple in nature by doctor. Prior to this case, petitioner side had filed a case against the informant and the instant case is counter blast of the said case. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VI, Motihari in Mehsi Police Station Case No. 190 of 2022/GR No.3607 of 2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
