The petitioner apprehends his arrest in Raniganj P.S. Case No. 164 of 2010, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. According to the prosecution case, the informant named the petitioner and others and alleged that they having armed with different weapons came. Rajkumar Yadav, the petitioner is alleged to have assaulted the informant with Pharsa on his head and right eye.
Learned counsel for the petitioner submits that the occurrence took place due to land dispute. The petitioner and other accused persons are co-sharer of the informant. The case is compromised. Other three accused persons have already been
Patna High Court Cr.Misc. No.6730 of 2015 (2) dt.19-02-2015 2/2 enlarged on bail. It is submitted that there is very specific allegation against the petitioner, but the injury is simple in nature and the case is compromised.
Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Sanjay Singh, the learned Judicial Magistrate, 1st Class, Araria in connection with Raniganj P.S. Case No. 164 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
