JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 409 of the Indian Penal Code. Allegation in brief is that the petitioner being Mukhiya at the relevant time committed irregularity in purchasing of solar light and hand pipes.

It is submitted that it is not the case that any purchase was not made. Only allegation is about the violation of guidelines in purchase and such type of case was lodged at many places all over the State and the concerned Mukhiya and Panchayat Sachiv are admitted on anticipatory bail by this Court and the allegation is almost identical.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of

No.5781 of 2017 (2) dt.07-02-2017 2/2 receipt of this order to the concerned court, let the petitioner, namely, Jitan Mandal @ Jiten Mandal be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No.29 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
