The petitioners apprehend their arrest in Vaishali P.S. case No. 75 of 2019 registered under Section 341, 323, 363, 365, 384, 504, 506 of the IPC.

The informant alleged that both the petitioners along with Nawal Kishore Ram, Jaleshwar Ram and Mukesh Kumar kidnapped his son Chanchal Kumar for the purpose of forcible marriage.

The learned counsel for the petitioners submits that informant himself sent his son somewhere else and lodged this case only because much prior to the alleged occurrence daughter of Nawal Kishore Ram, one of the accused in the present case, lodged Vaishali P.S. case No. 55 of 2019 u/s 376, 493/34 of the

Patna High Court CR. MISC. No.59342 of 2019(2) dt.25-09-2019 2/2 IPC against Chanchal Kumar, Raj Narayan Paswan, Aarti Kumari, Chandan Kumar Paswan, Ruby Kumari and Mala Kumari. Petitioner No.1 is brother of the victim and petitioner No.2 is also relation of the victim.

Taking into consideration the facts that sister of petitioner No.1 lodged the case for outraging her modesty against informant of the present case and others, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. case No. 75 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
