JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 324, 307, 504, 506/34 of the Indian Penal Code.
It is alleged that the accused persons including the petitioner entered into the bogie of the train, co-accused Sanjay Das assaulted the informant by 'nepali katta' whereas the petitioner assaulted brother-in-law of the informant namely Anil Das with sword and the injury of Anil Das has been found grievous.
It is submitted by learned counsel for the petitioner that accusation has been levelled in the background of land dispute. The petitioner side has earlier lodged Belhar P.S. Case No.152 of 2011 levelling accusation under Sections 448, 341,
Patna High Court Cr.Misc. No.13182 of 2015 (2) dt.31-03-2015 2/2 323, 324, 504, 506, 307/34 of the Indian Penal Code against the informant and others and the petitioner is a disabled person. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, this Court is not inclined to interfere. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with G.R.P. Jamalpur P.S. Case No.1 of 2015, pending before the Rail Judicial Magistrate, Kiul.
With the above observation, this application is, accordingly, disposed off.
