2. The accused-petitioner, named in the F.I.R., is apprehending his arrest in connection with Cyber P.S. Case No. 35 of 2025 registered for the offences punishable under Sections 316(2), 318(4) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.') and section 66(C) and 66(D) of the I.T. Act.
3. As per FIR, petitioner alongwith other accused persons found having transaction with Bank, where on suspicion, one co-accused was apprehended namely, Mohit Kumar, who disclosed the name of this petitioner saying that

4. Mr. S.N.P. Singh, learned senior counsel appearing on behalf of the petitioner submitted that name of this petitioner transpired on the basis of disclosure made by apprehended co-acused namely, Mohit Kumar.
5. It is pointed out by Mr. Singh that nothing incriminating was recovered from this petitioner. It is submitted that the amount in issue i.e. Rs. 9,38,357/- was deposited with the account of apprehended co-accused Mohit Kumar, out of which Rs. 9,11,622/- was withdrawn. It is further submitted that even said co-accused Mohit Kumar was granted bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 67281 of 2025 dated 17.09.2025. Petitioner claimed to be a man of clean antecedent.
6. Learned A.P.P. for the State opposes the prayer of anticipatory bail of the petitioner.
7. In view of the aforesaid factual submissions and by taking note of the fact as name of the petitioner transpires on

No.62534 of 2025(3) dt.12-11-2025 3/3 the basis of suspicion arising out of disclosure made by apprehended co-accused namely, Mohit Kumar, coupled with the fact that petitioner is a man of clean antecedent, accordingly, above-named petitioner, in the event of his arrest/surrender within a period of four weeks from this order, is directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Ara/concerned court in connection with Cyber P.S. Case No. 35 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
